PEO compliance

Compliance is the word providers use most and define least. In a co-employment arrangement some obligations genuinely move, some are shared, and some stay entirely with you no matter what the brochure implies. Knowing which is which is how you avoid paying for reassurance rather than protection.

What genuinely moves

Payroll tax calculation, deposit and filing, and with a certified organisation the federal employment tax liability on wages it pays under a qualifying contract. Workers' compensation cover, where the arrangement includes it. Statutory notices and much of the employment paperwork. These are administrative, repeatable and exactly what a provider is good at.

What is shared and often misunderstood

Wage and hour compliance is the clearest example. The provider can build correct overtime calculation into the pay run, and it cannot know whether the hours you submitted are the hours worked, or whether a role you classified as exempt actually is. Misclassification of employees and mis-recorded hours originate with the employer, and the pay run faithfully computes whatever it is given.

What stays with you entirely

How you treat people. Discrimination, harassment and unfair dismissal claims follow the party doing the treating, and a co-employer's indemnity is not a substitute for managing well. Ask any provider to point at the clause that says otherwise, and read what it actually covers, because the answer is usually narrower than the sales conversation.

Does a PEO make me compliant?

It carries the administrative obligations well and cannot carry your management decisions. Payroll tax filing genuinely moves; wage and hour accuracy depends on the hours and classifications you supply; conduct claims stay with the party doing the treating.

Who is liable if payroll taxes are not paid?

With a certified organisation the IRS treats the CPEO as solely liable for federal employment taxes on wages it pays under a qualifying contract. Under an uncertified arrangement a client can remain exposed.

What compliance should I keep an eye on myself?

Employee classification, the hours you submit, and how people are managed. Those originate with you and a provider computes faithfully whatever it is given.
